Terms of use

1. ASSUMPTION OF RISK, RELEASE & INDEMNITY

Pickleball and related activities involve inherent physical risk, including but not limited to falls, collisions with other players, contact with balls, paddles or equipment, and strain or other injury from physical exertion.

1.1 Risk warning (Civil Liability Act 2002 (NSW), ss 5K–5N)

THIS IS A RISK WARNING under the Civil Liability Act 2002 (NSW).

Pickleball is a recreational activity that carries a risk of physical injury, including but not limited to sprains, fractures, collisions with other players or the court surface, and, in rare cases, more serious injury. By participating, you accept that these risks are inherent to the activity and may not be eliminated by any precaution GO PICKLE takes.

1.2 Release, waiver and indemnity

By entering or using a GO PICKLE facility, each customer and participant acknowledges and agrees that:

  1. Assumption of risk. They voluntarily assume all risks of injury, illness, death or property damage arising from their participation in activities at the venue, whether arising from their own actions, the actions of other players, or the condition of the premises or equipment.
  2. Waiver of liability. To the extent permitted under s 5N of the Civil Liability Act 2002 (NSW) and s 139A of the Australian Consumer Law (Sch 2, Competition and Consumer Act 2010 (Cth)), they waive and release GO PICKLE, its owners, operators, staff and agents from liability for personal injury, illness, death or property damage arising from their participation in recreational activities at the venue.
  3. Statutory limits on the waiver. This waiver does not exclude, and nothing in these terms excludes, liability for:
  • death or personal injury caused by GO PICKLE’s gross negligence or reckless conduct;
  • defects in the venue, equipment or premises that are not an inherent or obvious risk of the recreational activity itself; or
  • any liability that cannot lawfully be excluded, restricted or modified under the Civil Liability Act 2002 (NSW), the Australian Consumer Law, or other applicable NSW or Commonwealth law.
  1. Fitness to participate. They are voluntarily participating and are responsible for assessing their own fitness and medical suitability to do so. Customers with a medical condition that could affect their ability to safely participate should consult a medical professional before playing.
  2. Indemnity. The account holder indemnifies GO PICKLE against any loss, claim or liability arising from the acts or omissions of themselves or any participant or guest included in their booking, except to the extent caused by GO PICKLE’s gross negligence or reckless conduct.
  3. Minors. Where a participant is under the age of 18, a parent or legal guardian must accept these terms, including this release, on the minor’s behalf, and remains responsible for the minor’s supervision and conduct while at the venue unless a GO PICKLE program explicitly provides supervised instruction.

2. CCTV — RETENTION, SCOPE & CUSTOMER RIGHTS

  1. Audio. GO PICKLE’s camera systems capture audio incidental to video recording. Any audio captured is very low volume and is not intended or suitable for listening back to, transcription, or any other use.
  2. Retention.
  • Security/venue monitoring footage is retained for 30 days from the date of recording, after which it is automatically deleted.
  • Where GO PICKLE offers replay/highlight capture on courts, uncaptured replay camera feed is retained for 48 hours before permanent deletion. Any replay a customer or admin actively captures within that window is retained in the customer’s profile until the profile is deleted.
  1. Signage. Notices indicating that camera recording (video, and where applicable audio) is in operation are displayed at venue entrances and within the facility.
  2. Access and deletion requests. A customer may delete their own profile and associated data at any time via the booking app (Account Info → Account → Delete Account). Deleting a profile cancels upcoming reservations, deletes held credits, and redacts the customer’s name and email from GO PICKLE’s and PodPlay’s systems. GO PICKLE staff/admins can action a deletion request on a customer’s behalf via the booking platform’s dashboard. Any captured/favorited replay footage tied to a profile is deleted at the same time; security camera footage separately ages out per the 30-day window above regardless of profile status.
  3. Third-party service providers. CCTV, booking and related customer data are hosted and processed by GO PICKLE’s booking platform provider (PodPlay) and its subprocessors, who are bound by their own data-handling and security practices.
  4. No promotional use. CCTV or replay footage will not be used for marketing, promotional or social media purposes without the specific, separate consent of those involved.

3. PAYMENT AUTHORISATION FOR ADDITIONAL CHARGES

  1. By making a booking, the account holder authorises GO PICKLE to charge the payment method on file for:
  • additional court usage arising from overstay beyond the booked period;
  • additional guest, participant or court fees arising from unregistered or additional players identified as using the booking;
  • reasonable costs of repair, replacement or cleaning arising from damage or misuse caused by the account holder’s group, in accordance with the “Damage & Recovery of Costs” section.
  1. Where reasonably practicable, GO PICKLE will notify the account holder of the reason and amount of any such charge before or promptly after it is applied.
  2. An account holder may dispute a charge under this section by contacting ropescrossing@gopickle.com.au within 30 days of the charge, and GO PICKLE will review the relevant booking, access and (where applicable) CCTV records in determining the outcome.

4. LOST OR DAMAGED PERSONAL PROPERTY

GO PICKLE is not responsible for the loss, theft or damage of personal property brought onto the premises, except to the extent caused by GO PICKLE’s negligence. Customers are responsible for their own belongings, including items left in courts, common areas or lockers.

6. INFRACTIONS POLICY

GO PICKLE is committed to providing a safe, enjoyable and respectful environment for all customers, staff and coaches. This Infractions Policy sets out common situations that may result in a charge to the account holder’s payment method, in addition to GO PICKLE’s general rights under “Unauthorised Access & Misuse” and “Damage & Recovery of Costs” above.

Charging infractions.  By making a booking, the account holder authorises GO PICKLE to charge the fees below to the payment method on file for infractions committed by themselves or a member of their group.

Consequences of repeated infractions.  In addition to any fee charged, repeated or serious infractions may result in a temporary suspension of booking or venue-access privileges, or permanent cancellation of membership or access, consistent with the “Unauthorised Access & Misuse” section above.

Infractions and associated cost-recovery fees:

  1. Overstay. A group remaining on a court more than 30 minutes past the end of their booking will be charged for the additional court time at the applicable rate.
  2. Extra court/unbooked court use. A group using an additional court beyond what was booked will be charged for that court at the applicable rate.
  3. Extra guests. Where the group exceeds the booked or permitted number of participants, the account holder will be charged the applicable additional-participant fee per the “Authorised Players & Participant Numbers” section above.
  4. Unpaid products, food or beverage. Any food, beverage, equipment hire or merchandise taken without payment will be charged at its listed price, plus a reasonable administration fee.
  5. Misuse of equipment causing damage. Misuse of paddles, balls, nets or other equipment resulting in damage will be charged at the reasonable cost of repair or replacement, per the “Damage & Recovery of Costs” section above.
  6. Excess cleaning required. Where a group leaves a court or common area requiring extraordinary cleaning beyond normal use, a reasonable cleaning fee will be charged.
  7. Alteration of fixtures or equipment. Moving or altering fixed furniture, nets, barriers or other venue fixtures without authorisation may result in a charge for the cost of resetting or repairing them.
  8. Unattended minors. Minors left unsupervised in violation of venue rules or the “Minors” clause above may result in a fee and/or a requirement that a guardian collect the minor before further access is permitted.
  9. Pets. Unattended pets, or mess caused by a pet, in violation of venue rules may result in a cleaning fee.
  10. Disruptive, threatening or dangerous behaviour; alcohol, smoking or drug use; noise disturbances; inappropriate physical contact; or incidents requiring police involvement. These will not be tolerated. Rather than a fixed dollar fine, such conduct will be addressed primarily through suspension or termination of booking/access privileges under “Unauthorised Access & Misuse” above; GO PICKLE may additionally charge a fee only to the extent it reflects GO PICKLE’s actual and reasonable costs (e.g., cleaning, repair, additional staff time) arising from the conduct.

7. GOVERNING LAW & DISPUTES

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any dispute arising from these terms or a customer’s use of a GO PICKLE facility will first be addressed through GO PICKLE’s internal review process described above, and if unresolved, will be subject to the exclusive jurisdiction of the courts of New South Wales.
